Build America, Buy America Act (BABA) Compliance
Commitment to Supporting American Manufacturing
Flow Optimizers is committed to full compliance with the Build America, Buy America Act (BABA), requiring U.S.-made materials for federally funded projects. We proudly support American manufacturing, job creation, and economic growth.
How Flow Optimizers Ensures BABA Compliance
At Flow Optimizers, we have implemented robust measures to maintain compliance with BABA requirements. These include:
1. Internal Policies and Procedures
We prioritize U.S.-produced materials in all aspects of our supply chain. Our procurement processes are continually updated to reflect the latest BABA guidelines and ensure adherence to federal requirements.
2. Supplier Verification
We work closely with our suppliers to verify that their materials meet BABA standards. Each supplier is required to provide certifications verifying the domestic origin of their products.
3. Comprehensive Documentation
We maintain detailed records of the materials used in each project, including manufacturing certifications, supplier audits, and compliance reports, ensuring transparency at every step.
4. Training and Awareness
Our team undergoes regular training on BABA requirements, ensuring that all employees understand the importance of compliance and how to meet federal standards.
Supplier Expectations
Flow Optimizers requires all suppliers and partners to meet the following standards:
- Provide certifications confirming that all materials comply with BABA requirements.
- Disclose manufacturing processes and origin details for products.
- Notify us of any potential compliance challenges in advance.
This collaborative approach ensures that we deliver products that meet both regulatory and performance standards.
Waiver Information
While Flow Optimizers strives to use 100% U.S.-produced materials, we acknowledge that exceptions may apply in certain situations. Waivers to the Build America Preference may be granted in cases where:
- The materials are not produced in the U.S. in sufficient quantity or quality.
- Using American-made materials would increase the cost of the project by more than 25%.
- Applying the domestic preference would conflict with public interest.
For more information about waivers, refer to the U.S. Department of Commerce’s guidance on BABA compliance.
